Definition

1. imperialgeneve is a limited liability company that runs web portal business services  www.imperialgeneve.com, which is a shop search site and Goods sold by registered sellers. Hereinafter referred to as imperialgeneve.

2. imperialgeneve’s website is www.imperialgeneve.com.

3. Terms & conditions are an agreement between the User and imperialgeneve which contains a set of regulations governing the rights, obligations, responsibilities of the user and imperialgeneve, as well as the procedure for using the imperialgeneve service system.

4. Users are parties who use imperialgeneve services, including but not limited to buyers, sellers or other parties who just visit the imperialgeneve Site.

5. Buyer is a registered user who requests for goods sold by the seller on the imperialgeneve site.

6. Seller is a registered user who takes action to open a shop and / or make an offer for an item to the imperialgeneve Site Users.

7. Goods are tangible / physical goods Goods that can be delivered / meet the shipping criteria by the freight forwarding company.

8. Refund Balance is a temporary storage facility for Buyer’s funds (not a fund storage facility), which is provided by imperialgeneve to accommodate refunds on purchases of goods, digital products, and / or financial products. These funds can only be used again to make purchases on the Alshabiba Site and / or be withdrawn to a registered bank account.

9. Income Balance is a temporary storage facility for Seller’s funds (not a fund storage facility), which is provided by imperialgeneve to collect funds from the sale of goods, investment products, and / or affiliate commissions on the imperialgeneve Site. These funds can only be withdrawn to a registered bank account and cannot be used again to make purchases on the imperialgeneve Site.

10. Feed is a feature on the imperialgeneve Site / Application that displays content from the Seller, KOL, or other parties related to certain Goods.

11. Key Opinion Leaders or KOL is the party that promotes certain Goods or Sellers through Feed.

12. imperialgeneve Official Account is a joint account agreed by imperialgeneve and users for the process of buying and selling transactions on the imperialgeneve Site.

13. Internal Dropshipper is a transaction that entirely takes place in the scope of imperialgeneve which is carried out by the Seller by buying Goods from other Sellers and reselling them through the imperialgeneve Site.

Account, Refund Balance, Income Balance, Password and Security

1. The user hereby declares that the user is a capable person and is able to bind himself in a legal agreement.

2. imperialgeneve does not charge registration fees to users.

3. The user understands that 1 (one) telephone number can only be used to register 1 (one) imperialgeneve User account, except for Users who already have multiple accounts with 1 (one) previous telephone number.

4. Users who have registered are entitled to act as:
   – Buyers
   – Sellers, by utilizing store open services.

5. Users who will act as sellers are required to choose the option to use store open services. After using the store open service, the User has the right to make arrangements for items that will be traded in the User’s personal window.

6. Users who have taken shop opening actions are expected to upload product content that will be traded within 90 (ninety) calendar days after the store has been successfully opened. If within 90 (ninety) calendar days the User still does not upload product content, then the User agrees and understands that imperialgeneve has the right to moderate and / or close the store without prior notice.

7. imperialgeneve without prior notice to the User, has the authority to take necessary actions on any alleged violation or violation of the Terms & Conditions and / or applicable laws, namely actions in the form of moving the goods to the warehouse, removal of the goods, store moderation, store closure, listing cancellation , account suspension, and / or deletion of user accounts.

8. imperialgeneve has the authority to close the shop or the User account both temporarily and permanently if there are acts of fraud in transactions, violations of the imperialgeneve Terms and Conditions, including but not limited to the User Penalty Policy which you can see HERE . The user agrees that Alshabib has the right to take other necessary actions related to this matter, including but not limited to refusing to submit a new store opening if data similarity is found.

9. Users are prohibited from creating and / or using devices, software, features and / or other tools that aim to manipulate the imperialgeneve system, including but not limited to: (i) manipulation of Store data; (ii) crawling / scraping activities; (iii) automation activities in transactions, buying and selling, promotions, etc.; (v) adding products to the storefront; and / or (vi) other activities that can be reasonably valued as acts of system manipulation.

10. imperialgeneve has the authority to make adjustments to the number of store transactions, adjust the number of reputations, and / or carry out a moderation process / close the User’s account, if a User is known or suspected of fraud in order to manipulate User transaction data in order to improve the store’s reputation (review and or number of transactions) . An example is the process of shopping to the store itself using a personal account or other personal accounts.

11. Refund balances originate from a refund of the purchase of goods, digital products, and / or financial products on the imperialgeneve Site and cannot be topped up by themselves.

12. Refund balances can be used as one of the payment methods for purchases of goods, digital products, and / or investment products on the imperialgeneve Site, and funds can be withdrawn (withdrawal) to the bank account registered in the User account.

13. The income balance only comes from the sale of goods, investment products, and / or affiliate commissions on the imperialgeneve site and cannot be topped up by themselves.

14. Income balances can only be withdrawn to a bank account registered in the User’s account, and cannot be used as a payment method for purchases of goods, digital products, and / or investment products on the imperialgeneve Site, but can be used for features a subscription that helps Sellers, like TopAds or store cashback promos.

15. imperialgeneve has the authority to freeze the Refund Balance and User Income Balance if it is found / suspected of fraud in the transaction and / or violation of the terms and conditions of imperialgeneve.

16. Sellers are prohibited from duplicating stores, duplicating products, or other actions that could be indicated as unfair competition.

17. The user does not have the right to change the user’s store name and / or store domain.

18. The user has the right to make changes to the account name as many times as the number of opportunities provided and imperialgeneve has the right to change the number of opportunity changes to the account name. The user must ensure that changes to the account name are what they want and are personally responsible for changes in account names made by the user. The user agrees that any engagement that occurs before the name change remains binding on the User.

19. The user is personally responsible for maintaining the confidentiality of the account and password for all activities that occur in the User’s account.

20. imperialgeneve will not ask for a username, password or SMS verification code or OTP code belonging to the user’s account for any reason, therefore imperialgeneve calls on the User not to provide such data or other important data to those on behalf of imperialgeneve or other parties whose security cannot be guaranteed.

21. The User agrees to ensure that the User leaves the account at the end of each session and notifies imperialgeneve if there is unauthorized use of the User’s password or account.

22. The User hereby declares that imperialgeneve is not responsible for any losses or constraints arising from misuse of User accounts caused by User’s negligence, including but not limited to lending or giving account access to other parties, accessing links provided by other parties, providing or show verification codes (OTP), passwords or e-mails to other parties, or other User negligence that results in losses or constraints on the User’s account.

23. The User understands and agrees that to use the One Time Password (OTP) security facility, the relevant telecommunications service provider may charge the User at any time with a nominal value.

24. Sellers are prohibited from promoting stores and / or goods directly using the private messaging facility, product discussions, product reviews that can interfere with the comfort of other users.

Purchase

1. Buyers are obliged to transact through the transaction procedures set by imperialgeneve. Buyers make payments using the payment method previously selected by the Buyer, and then imperialgeneve will forward the funds to the Seller if the stages of the sale and purchase transactions on the imperialgeneve system are complete.

2. When purchasing an item, the Buyer agrees that:

   1. The buyer is responsible for reading, understanding and agreeing to the information / description of the whole goods (including but not limited to color, quality, function, etc.) before making an offer or commitment to buy.

   2. Buyer acknowledges that the actual color of the product as seen on the imperialgeneve site depends on the Buyer’s computer monitor. imperialgeneve has made its best efforts to ensure the colors in the photos displayed on the imperialgeneve Site appear as accurately as possible, but cannot guarantee that the color appearance on the imperialgeneve Site will be accurate.

   3. The user enters into a legally binding contract to buy the Goods when the User buys an item.

   4. imperialgeneve does not transfer legal ownership of goods from the Seller to the Buyer.

3. The Buyer understands and agrees that the availability of stock of goods is the responsibility of the Seller who offers the Item. Related to the availability of goods stock may change at any time, so that in the condition of stock of goods is empty, then the seller will reject the order, and payment for the item in question is returned to the Buyer.

4. The Buyer fully understands and agrees that all transactions carried out between the Buyer and the Seller other than through the imperialgeneve Official Account and / or without imperialgeneve’s knowledge (through private facilities / networks, message delivery, special transaction arrangements outside the imperialgeneve website or other efforts) are the personal responsibility from the Buyer.

5. imperialgenevehas full authority to refuse payment without prior notice.

6. Payment by the Buyer must be made immediately (no later than the 2 day deadline) after the Buyer checks out. If within the time limit the payment or confirmation of payment has not been made by the buyer, imperialgeneve has the authority to cancel the transaction. The user has no right to submit a claim or claim for canceling the transaction.

7. Payment confirmation with cash deposit must be accompanied by news on the deposit slip in the form of an invoice number and name. Confirmation of payment by cash deposit without information will not be processed by imperialgeneve.

8. The buyer agrees not to notify or submit proof of payment and / or payment data to parties other than imperialgeneve. In the event of a loss due to notification or submission of proof of payment and / or payment data by the Buyer to another party, this will be the responsibility of the Buyer.

9. The buyer is obliged to confirm receipt of the goods, after receiving the shipment of purchased goods. imperialgeneve gives a time limit of 2 (two) days after sending the status of “sent” on the imperialgeneve system, for the Buyer to confirm receipt of the Goods. If within the deadline there is no confirmation or claim from the Purchaser, the Buyer then agrees to confirm the receipt of the Goods automatically by the imperialgeneve system.

10. After confirming receipt of the goods or automatic confirmation of receipt of the goods, the Buyer’s funds sent to the imperialgeneve official account will be sent to the seller (the transaction is deemed completed).

11. The buyer understands and agrees that any claim that is submitted after the confirmation / automatic confirmation of receipt of the Goods is not the responsibility of imperialgeneve. Losses arising after automatic confirmation / confirmation of receipt of the Goods are the responsibility of the Buyer personally.

12. The Buyer understands and agrees that any item delivery problems caused by late payment are the responsibility of the Buyer.

13. The Buyer understands and agrees that the problem of late payment processing and additional fees caused by the difference in the bank that the Buyer uses with the imperialgeneve official bank account is the Buyer’s personal responsibility.

14. Refunds from imperialgeneve to Buyers can only be done if under certain circumstances the following:

    1. Excess payment from the Buyer on the price of the Goods,

    2. The problem of sending the goods has been clearly identified from the seller which results in the order of the goods not arriving,

    3. Sellers cannot afford orders because they are out of stock, changes in shipping costs, or other causes,

    4. The seller has agreed to send the order of the goods, but after the specified time limit it turns out the seller does not send the goods until the specified deadline.

    5. Resolution of problems through the Resolution Center in the form of a decision to refund to the Buyer or the results of the decision from imperialgeneve.

15. In the event of a refund process, the refund will be made through the User’s Refund Balance which will increase according to the refund amount. If the User uses the choice of credit card payment method, the refund will refer to the provisions in part M related to Credit Card.

16. imperialgeneve has the authority to make decisions on transaction problems that have not been resolved due to the absence of a settlement agreement, both between Seller and Buyer, by looking at the available evidence. imperialgeneve’s decision is a final decision that cannot be contested and binds the Seller and Buyer to comply.

17. If the Buyer chooses to use the bank transfer payment method, a total unique code will be added to simplify the verification process. In the event that payment has been verified, the unique code will be returned to the Buyer’s Refund Balance.

18. Buyers are required to make a nominal payment in accordance with the bill amount along with a unique code (if any) listed on the payment page. PT imperialgeneve is not responsible for losses suffered by the Buyer when making payments that do not match the number of bills listed on the payment page.

19. The Buyer fully understands and agrees that the invoice issued is in the name of the Seller.

Sales Transaction

1. Sellers are prohibited from manipulating the price of goods for any purpose.

2. Seller is prohibited from offering / trading prohibited goods in accordance with the provisions in Point J. Type of Goods.

3. The seller is required to provide complete and clear photos and product information in accordance with the conditions and quality of the products he sells. If there is a mismatch between photos and product information uploaded by the Seller to the product received by the Buyer,imperialgeneve has the right to cancel / withhold the transaction funds.

4. In using the “Product Title”, “Product Photo”, “Notes” and “Product Description” Facilities, Sellers are prohibited from making standard clause regulations that do not meet the applicable laws and regulations in Indonesia, including but not limited to (i) not accepting complaints, (ii) not receiving returns (exchanging goods), (iii) not receiving refunds, (iv) non-guaranteed items, (v) transfer of responsibility (including not limited to shipping costs), (vi) ) depreciation in value and (vii) unilaterally sending random items. If there is a conflict between store records and / or product descriptions with imperialgeneve Terms & Conditions, the applicable rules are the imperialgeneve Terms & Conditions.

5. The Seller is obliged to give a reply to accept or reject the order of the Buyer’s Goods within 2 days after the notification of the Goods order from imperialgeneve. If within the time limit there is no reply from the seller then the order will automatically be canceled.

6. In order to maintain the convenience of the Buyer in the transaction, the Seller understands and agrees that imperialgeneve has the right to moderate the Seller’s store if the Seller refuses, cancels and / or does not respond to the Buyer’s Goods order with allegations to manipulate transactions, violations of the Terms and Conditions, and / or fraud or other abuse.

7. Sellers are expected to enter a valid Goods shipping receipt or AWB (air way bill) number, namely:

   • The date of manufacture of the Goods shipment receipt does not precede the date of the purchase transaction of the Goods;

   • The shipping receipt number of the Goods must be traceable or found on the web site of the tracking site or the imperialgeneve partner expediting service system; and / or

   • It is a delivery receipt for the Goods intended for the buyer who will receive the package (shipping details must be the same).

8. The seller is required to enter a valid Item delivery receipt number within the 2 x 24 hour time limit (excluding Saturdays / Sundays / National holidays) from the date of notification of the Goods order from imperialgeneve.

9. If the Seller enters an invalid or invalid item delivery receipt number, the Seller is required to enter a valid Goods shipping receipt number within the 1 x 24 hour time limit (excluding Saturdays / Sundays / National holidays) from the date of notification of invalid receipt numbers or not tracked by imperialgeneve to Sellers.

10. If within the time limit stated in Terms & Conditions Points D. 8 and D. 9 the Seller does not enter a valid Goods receipt number, then the order is automatically deemed canceled. If the Seller continues to ship the Goods after exceeding the delivery deadline as described above, the Seller understands that the transaction will still be canceled and then the Seller can withdraw the Goods at the courier where the Goods were sent.

11. The Seller understands and agrees that the shipping courier cannot be changed by the Seller after the Seller confirms the shipment and is entirely the responsibility of the Seller. A more complete explanation can be seen here .

12. imperialgeneve has the authority to cancel the transaction and / or withhold the transaction funds in the event that: (i) the courier receipt number of the Goods provided by the Seller is not appropriate and / or is suspected to be incompatible with transactions that occur on the imperialgeneve Site; (ii) Seller sends the Goods through courier / logistics services other than those provided and connected to the imperialgeneve Site; (iii) if the product name and product description do not match / are not clear with the product sent; (iv) if transaction manipulation is discovered; and / or (v) state the number of the delivery receipt of the Goods that have been used by other Sellers (internal dropshipper)

13. The Seller understands and agrees that the Seller Income Tax will be reported and managed by each Seller in accordance with the tax provisions in force in the laws and regulations in Indonesia.

14. imperialgeneve has the authority to make decisions on transaction problems that have not been resolved due to the absence of a settlement agreement, both between Seller and Buyer, by looking at the available evidence. imperialgeneve’s decision is a final decision that cannot be contested and binds the Seller and Buyer to comply.

15. If agreed by the Seller and Buyer, the use of Logistics services that are different from the buyer’s initial choice can be made (provided that the shipping rates are below the initial shipping rate).

16. imperialgeneve has the authority to cut the excess shipping rates from the buyer’s payment funds and return the excess shipping rates to the buyer.

17. The Seller fully understands and agrees that the invoice issued is on behalf of the Seller.
